1. Introduction

1.1. This document constitutes the privacy statement of BITS Pty Limited (ACN 059 639 771) ("BITS") and sets out the policy of BITS in relation to the collection, use and disclosure of personal information.

Personal information collected by BITS will be treated by BITS in accordance with this privacy statement and BITS will comply with the Privacy Act 1988 (Cth) ("the Act") and the National Privacy Principles provided for under the Act. BITS' privacy statement will apply to any personal information collected from you by BITS, including but not limited to personal information collected via this website.

1.3. By providing personal information to BITS you agree to allow BITS to use and disclose that personal information in accordance with this privacy statement and in compliance with the Act.

1.4. In this Privacy Statement "Personal Information" means information or an opinion (including information or an opinion forming part of a database) whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from that information or opinion and includes an individual's name, address, telephone number, date of birth or email address.

2. Collection

2.1. BITS may collect Personal Information from you when you:

2.1.1. purchase products from BITS;
2.1.2. enter into any competition organised by BITS;
2.1.3. agree to receive direct marketing material from BITS; or
2.1.4. visit the BITS website.

2.2. When you visit the BITS website:

2.2.1. BITS collects and records information in relation to that visit;
2.2.2. if you do not perform an activity described in Clause 2.1:
2.2.2.1. that information will consist solely of "internet information" provided by your web browser/internet service provider;
2.2.2.2. BITS will not attempt to identify you and will be unlikely to be able to identify you from the information collected.

2.3. BITS uses cookies in accordance with the Terms of Use of the BITS website.

3. Use and Disclosure of Personal Information

3.1. The Personal Information collected:

3.1.1. will be used for the purpose stated by BITS when you provide the Personal Information to BITS;
3.1.2. will not be used by BITS for any purpose other than the stated purpose or any reasonably incidental purpose;
3.1.3. will not be disclosed by BITS to any person other than those persons to whom it is reasonably necessary for BITS to disclose the Personal Information in order to perform the function or activity for which the Personal Information was collected.

3.2. In particular, BITS will not "sell" the Personal Information to any person for the purpose of advertising.

3.3. BITS will not use the Personal Information for the purpose of direct marketing another person's products.

3.4. The Personal Information you provide to BITS may be used to:

3.4.1. process your purchase order;
3.4.2. carry out credit checking and scoring (unless BITS has agreed otherwise);
3.4.3. provide the products and/or services purchased by you;
3.4.4. obtain payment for your purchase;
3.4.5. deal with requests, enquiries or complaints and other customer care related activities;
3.4.6. carry out market and product analysis and marketing BITS products and services generally (subject to the other terms of this Privacy Statement);
3.4.7. carry out any activity in connection with a legal, governmental or regulatory requirement on BITS or in connection with legal proceedings, crime or fraud prevention, detection or prosecution.unless you inform BITS that you do not wish your personal information to be used for such purpose.

4. Quality, Security and Access

4.1. BITS undertakes to take all reasonable steps to ensure that the Personal Information it collects, uses or discloses is accurate, complete and up to date.

4.2. BITS undertakes to take all reasonable steps to ensure that the Personal Information collected by it from any misuse or loss and from any unauthorised access, modification or disclosure.

4.3. In the event that:

4.3.1. the Personal Information provided by you to BITS is no longer required by BITS for the purpose for which it was collected; or
4.3.2. you request BITS to do so BITS will destroy or permanently de-identify your Personal Information.

4.4. Subject to Clause 4.5 below, upon request by you, BITS undertakes to take reasonable steps to provide you with access to the information held by BITS.

4.5. If providing you with access to the Personal Information would reveal confidential information of BITS then BITS may provide you with an explanation in regards to that confidential information rather than providing you with access to the Personal Information.
